President Bush Signs Bill Reauthorizing E-Verify Program

On Sept. 30, President Bush signed H.R. 2638 into law, creating Public Law 110-329, a continuing resolution (CR) that contains a short-term reauthorization of the federal E-Verify program. E-Verify was set to expire on November 30, 2008, but the CR extends the program until March 6, 2009.
The CR is designed to fund government operations until Congress reconvenes after the first of the year. In addition to the extension, the CR funds the E-Verify program through fiscal year 2009.
The E-Verify program, operated by the Department of Homeland Security (DHS) and the Social Security Administration (SSA), permits participating employers to check the work status of new hires by comparing information from an employee's I-9 form against SSA and DHS databases. Though E-Verify remains a voluntary program, some states have mandated its use in some form and President Bush issued an Executive Order requiring federal contractors to use the program to verify the employment eligibility of their new hires. The terms of the Executive Order will not become effective until the final regulations are issued, which are expected at the end of 2008.
